Speedygate: ¿Quién manda aquí?

OSIPTEL debe poner freno a esto. Telefónica establece clausulas de suspensión en sus contratos que no corresponden a las autorizadas por OSIPTEL en las Condiciones de Uso de Servicios Públicos de telecomunicaciones.
Según la norma, solo se puede terminar el contrato de abonado en las siguientes circunstancias (art 56):

i. Por decisión del abonado.
ii. Por decisión de la empresa operadora, en caso de falta de pago del servicio,

iii. de acuerdo a lo establecido en el artículo 55°;

NOTA: El art 55 se refiere a que luego de un plazo (20 días) de haberse suspendido el servicio la empresa puede cancelarlo. Por ello es importante tomar en cuenta las causales de suspensión que establece Osiptel.

Artículo 51°.- Supuestos de suspensión del servicio
La empresa operadora únicamente podrá suspender el servicio:
(i) Por mandato judicial;
(ii) Por falta de pago
(iii) Por declaración de insolvencia
(iv) Por uso indebido del servicio, de conformidad con lo dispuesto en el procedimiento aprobado por el OSIPTEL;
(v) Por cualesquiera de las causales previstas en la presente norma y en las demás normas aprobadas por el OSIPTEL;
(vi) Por traslado del servicio realizado sin la autorización previa de la empresa operadora; o,
(vii) Por las causales establecidas en el contrato de abonado, siempre que el OSIPTEL hubiera otorgado su conformidad al mismo. En ningún caso, estas causales podrán estar referidas a supuestos que sean calificados por la empresa operadora como uso indebido del servicio.

iii. Por fallecimiento del abonado.
iv. Por declaración de insolvencia;
v. Por lo dispuesto en el artículo 14º [Incumplimiento de instalación y/o activación del servicio]
vi. Por lo dispuesto en el artículo 47º [Factibilidad del traslado]
vii. Por uso indebido del servicio, previa aplicación del procedimiento aprobado por el OSIPTEL; o,
viii. Por las causales establecidas en el contrato de abonado, siempre que el OSIPTEL hubiera otorgado su conformidad al mismo. En ningún caso, estas causales podrán estar referidas a supuestos que sean calificados por la empresa operadora como uso indebido del servicio.”

En conclusión el contrato no debería establecer nada que no haya sido aprobado por OSIPTEL.

  • ¿Aprobó OSIPTEL las clausulas de los contratos señalados?
  • ¿Sabemos qué es lo que OSIPTEL aprueba o no aprueba?
  • ¿Sabemos si lo que dicen nuestros contratos fue aprobado por OSIPTEL?

Algunas perlas de este contrato de Speedy:

El contrato estaría diciendo que nos podrían cortar el servicio (resolver el contrato) si:

  • No contamos con “sistema operativo Windows 95, Windows 98, Windows 2000, Windows Millenium, Windows NT, XP, Vista o 7” (¿No es esto discriminación?)
  • Si no cumplimos con la Política anti – Spam de telefónica (¿No tenemos acaso una ley reglamentada para estos casos? ¿Esta Ley acaso delega en la empresa la autoridad de sancionar?).
  • Si se infringen los derechos de propiedad intelectual (¿No era Indecopi la autoridad? ¿Ahora Telefónica tiene autoridad para sancionar en esta materia?).
  • Si no se cumple con las Políticas de Uso Aceptable (entre las que se incluye no publicar información “inexacta, exagerada o extemporánea” – ver página 9) y LO PEOR es que además en este caso  TdP se atribuye el poder de adoptar las medidas “que considere adecuadas”, así como de “resolver el contrato, en cualquier momento de manera automática” … A ellos no les importa si OSIPTEL dice lo contrario en todas sus normas: ellos resuelven y punto.
