Ayer Telefónica respondió a los usuarios mediante un comunicado en su página de facebook (ver) en el cual, en resumidas cuentas dice que:
- Los cortes “aún” no se aplicarán sino hasta que exista una herramienta de medición. Y se limitarán a los casos de reventa ilegal.
La “reventa ilegal” sería un “uso indebido” que aún no ha sido reglamentado por OSIPTEL y que para sancionarlo requiere un pronunciamiento de este organismo (ver Res. N° 060-2006-CD/OSIPTEL). Quien quiere pasar sobre las leyes e ignorar la autoridad del estado peruano es Telefónica. Por eso es inaceptable.
- Las cuotas de descarga no aplican para los contratos anteriores al 1 de julio de 2010. No se ha cambiado unilateralmente ninguna condición ya pactada.
Cuando te llaman por teléfono para ofrecerte el upgrade no te anuncian los cambios en las condiciones de contratación, haciendo honor a la frase “trabajamos para sorprenderte”. Los usuarios no sabemos en estos momentos si nuestros contratos están o no sujetos a estas condiciones. Por eso es inaceptable.
- Las cuotas de descarga establecidas para los diversos planes de Speedy exceden largamente el promedio de descarga, por lo que no tendrían efecto alguno para la gran mayoría de usuarios. Más del 99% de nuestros clientes consume menos de la cuota establecida para su contrato (*).
Hace unos días en su página en Facebook Telefónica dijo que esta medida no afectaba al 93%. Ahora que reclamamos dice 99% tratando de minimizar el tema. De esta forma ya no es posible confiar en esta cifra a menos que sea certificada por una autoridad competente. Por eso es inaceptable.
- El establecimiento de cuotas de descarga es aplicada por diversas operadoras en el mundo y por todos los operadores móviles en el Perú
La regulación peruana aplica en Perú, la Española en España. Señores: respeten las leyes peruanas. Este argumento es una falacia y por eso es inaceptable. Sobre lo de las móviles: gracias por el dato.
- Esta medida adicionalmente nos ayuda a combatir la reventa ilegal y la proliferación de conexiones clandestinas a la red, que son un fenómeno creciente que afecta a cada vez más clientes de uso residencial. En algunas localidades la reventa consume casi todos los recursos de la red, perjudicando gravemente a los clientes formales.
El uso compartido de Internet ha sido para el Perú la oportunidad de acceso a Internet de los más pobres. Esta medida afectará negativamente los indices de acceso de la población peruana a Internet.
Finalmente Telefónica no dice nada sobre:
- ¿Cómo contará cuantas máquinas tengo funcionando en mi casa simultáneamente? ¿Por qué 5 máximo? ¿y si tengo 6 … eso me convierte en un delincuente, en un ilegal, en un “business”?
- ¿Por qué los limites a los NAT? ¿Es que se quiere agravar la escasez de números IPv4?
- El contrato no establece un mínimo garantizado (como sí lo hacían los contratos anteriores) ¿cual será? ¿es que ya no pueden garantizar nada?
